Abstract:
"El problema de la independència en la nova Comissió Nacional dels Mercats i la Competència” is a work on the reform of the regulatory agencies and ensuring competition through the study of Law 3/2013 which is created by the CNMC . The work is an extension of 61 pages and is divided into an introduction and four chapters that budgets creating the CNMC is analyzed , its nature , organization and functions , and the criticism it has received its creation , giving special importance to the problem of independence in terms of management and operation in the field of sectoral regulation and supervision. The CNMC assumes the powers six Administrations sector regulatory functions. It is the case of entrenched after years of activity as the Commission for the Telecommunications Market (CMT) and the National Energy Commission (CNE) independent administrations. It is also the case of more recent independent administrations and poor implementation as the National Postal Sector (CNSP) or not even have come to formally establish, as the National Council of Audiovisual Media (CEMA). The CNMC also assumes the powers of the Railway Regulatory Committee (FRC) and unincorporated Airport Economic Regulation Commission (CREA) . The public debate, which is discussed in this paper has focused on the coexistence in one 's own independent administration of a competition authority and sector regulators own network functions in industries functions. The reviews have been numerous, as you can see the different sections of this paper , therefore inconsistencies arising from the coexistence of intervention tools , such as reducing the independence of a high concentration of functions of the new CNMC .
