Abstract:Bullying has been and is a reality that is often invisible to society; however, many people have seen some of these situations, whether playing the role of victim or perpetrator or just as a viewer. This shows that the power to change this reality lies in society, since it is society that creates, tolerates and suffers violence between equals. This paper aims to show the answer that the Spanish criminal law provides regarding to bullying and the treatment established both to the juvenile justice and the school. This work has focused on the study of five parts, which are necessary to contextualize this cruel reality that prevails in our society. Firstly, it is explained what bullying is, both from the social and legal standpoint. Secondly, the study focuses on the roles that children take in a bullying situation, i.e. knowing the characteristic attributes of the offender, victim and spectator, and what causes their behaviour. Thirdly, the present study shows the treatment received by the victim and the offender both in the educational and judicial scopes. Fourthly, it is mentioned the civil liability that the juvenile justice provides in case a minor carries a crime of bullying. And finally, it is appointed the most effective prevention programs, according to the conducted research in order to deal with bullying in the school. Thus, the aim of this study is to give an overview of what this social issue entails, with a focus on criminal liability of minors.
