Abstract:The aim of this project is to analyse the possible introduction of the institution of discreditings as post-trial measures of inquiry, due to the defencelessness produced by the time limit allowed to allege them. Both legal concepts are regulated in the Spanish Civil Procedure, Act 1/2000 of 7 January. A study of the law applicable to discreditings and post-trial measures of inquiry has been carried out and, furthermore, owing to the disagreements with the acceptance of post-trial measures of inquiry on the verbal proceedings, a new alternative is proposed to the aforementioned legal concept. Finally, once the numerous problems that this regulation entails have been identified, a new composition of articles is proposed.
