Abstract:The aim of the present work is to analyze the legal framework of the protected witness by studying the protection needs of this subject and relating these needs to the adopted legislative measures efficiency. Thus, a valuation of the effectiveness of the Organic Law 19/1994 of 23 December 1994 relating the protection of witnesses and experts in criminal prosecution will be carried out. For this purpose, it is necessary to analyze the limits of the concept of “witness” by clarifying what kind of subjects can be included in this concept and what type of protection measures will be implemented in order to guarantee their safety. Along these lines, it is believed convenient to stress the figure of the confidant, since he is a possible subject whose legal protection should be guaranteed. Nevertheless, neither the doctrine nor the Spanish jurisprudence has never born in mind the fact that the confidant is a subject to whom the protection contemplated by the Law should be given. The theoretical frame made around the figure of the confident has been carried out using an empirical study based on interviews to agents of different police forces. Apart from the analysis of the subjectivity of the abovementioned Law, the Spanish legislation protection measures for victims and witnesses have also been analyzed throughout the present work. It has been made a difference between the phase of the process where the measure is implemented and the type of measure implemented in every case. For this purpose, an analysis of all the areas of the Law 19/1994 has been carried out and it has been also made a jurisprudential study about the topic aforesaid. As far as the efficiency of the Law is concerned, it is possible to say that the aim of safeguarding these subjects is not fulfilled. For this reason, this Law 19/1994 could be qualified of deficient and obsolete.
