Abstract:
Stalking is a form of predatory harassment. It is a continuous course of conduct over a long period of time, unwanted by the taxpayer, which consists of several intrusive acts which seriously disrupts their life development. It is a behavior that has probably always existed in society, but it began to incriminate in the US in 1990 with the murder of actress Rebecca Schaeffer and the media scandal that caused his death. Following the attack the criminalization of stalking behavior has been extended, first coming to European countries with common law jurisdiction, and later spread to several other European countries, including Spain. The Istanbul Convention of 2011 on preventing and combating violence against women and domestic violence which was signed ad referendum on May 11, 2011 by Spain, being obliged to carry out the necessary modifications to its domestic law the effects of the application of the Convention in its entirety. Specifically, Article 34 requires the signatory parties to take the necessary legislative measures to criminalize the fact, when committed intentionally, to adopt, on several occasions, threatening behavior against another person carrying it to fear for his security. Under the reform of the Spanish Penal Code by the Organic Law 1/2015, the new Article 172 ter, which incriminates the behavior of stalking for the first time in Spain it was introduced. But these behaviors and punishing looked earlier in Spain with other crimes, which affect the legal rights of a personal nature that could possibly be affected by the conduct of harassment, although there were drawbacks to punish all stalking behavior by these other crimes.
