Abstract:In an economical an social crisis context, in which corruption of our civil servants is the main topic, the Spanish Criminal Code has been renovated. Taking advantage of the chance, this work tries to show the evolution of the bribery, as a classical corruption offence, in the Spanish Criminal Law. This process, which ends with the current renovation, has culminated with the introduction of the illegal financing of political parties crime. This project’s object has been restricted to the analysis of the different ways to commit bribery (telling apart active or passive, proper and improper, etc). It is also commented which is the legally protected, the concept of gift, the way of consumption of this offence, the successive renovation of this criminal figure and which may occur with the new illegal financing of political parties crime. The legislator has only increased the penalty for committing bribery but it hasn’t changed the legal description. Not adapting the legal description to the nowadays sophisticated practices will mean a loss of a great opportunity to palliate the effects of one of the problems that most concern to our society. Furthermore, with the new renovation of the Criminal Code and the input of the mentioned new crime, the frontier between bribery and illegal financing it is not clear in some cases. In reference to the second one, its insertion in our Criminal Code is positive. However, as it is explained in these pages, it could be done in a better way. In conclusion, it has been tried to give a purely legal approach to the problem of corruption, always from a criminal perspective, and through a constructive criticism.
