Abstract:
This study deals with the concept of transitional justice as a set of legal and policy measures related to times of political and social change and of transition from conflict or repression to democracy or peace. It defines the current concept of transitional justice while employing at the same time a historical approach to its emergence. Additionally, different national experiences are analyzed in order to understand each story of transition in their unique social, political, legal, cultural and economic context. The field of transitional justice reveals itself extremely complex and unable to provide an ideal prototype of justice. The study undertaken analyzes the role and work of the Special Rapporteur on the promotion of Truth, Justice, Reparation and Guarantees of Non-Recurrence in the exercise of its mandate, the impact of its reports and recommendations and the response of the national authorities regarding the implementation of the suggested measures. The UN expert places the participation of the victims in the center of the transitional justice design and shows that the four pillars of its mandate are the building blocks of a set of interconnected measures that complement each other and are designed to amend the consequences of violations and prevent their recurrence. Recent advances in the field of international law have not been accompanied by significant efforts in state areas and have failed to unify and integrate the societies. Despite the extensive international legislation and the contribution of the Special Rapporteur, the progress in this area depends on state authorities that have to take the necessary measures to punish the guilty, to recognize the rights of victims and to ensure the non-recurrence of the violations committed in the past.
