Abstract:This research work deals with the content of the Lex Rhodia of iactu, a compilation of customary law of the Hellenistic period from the island of Rhodes, famous for its importance concerning maritime trade and transport. Specifically, this study is based on the analysis of the content of this regulation, introduced in the Roman times piece of work: the Digest of Justinian. In this way, it can be seen how Roman people imported this regulation into their legal system. Amongst other things, it states the liability in case of general average and its contribution system. First of all, there is an introduction to the historical context, which shows the special economic and social situation and geographical location that led to the emergence of these customs. After that, there is a brief reference to the Roman lease contract or location conduction, as it used to be the contractual regime applied to the transport of goods. The core and most important part of this study consists of an analysis of the texts of the Digest, 14, 2; its content is interpreted extract by extract. Finally, and due to the importance that this regulation had, all what has been studied of the Roman regulation is put into relation with the current legislation, operative in our legal system, on general average: Act 14/2014, of July 24, on Navigation.
