Abstract:With this work, I wanted to study the relationship of the fundamental right of the presumption of innocence with parallel trials when dripping court proceedings it is constant and the newspaper company's disclosed to the public through of the appropriate media. In short, I have analysed this right from many aspects: first, a historical study to know what time is the starting point where we find this procedural safeguard regulated, based on the origin of Roman law (the Digest). Once at present, I have examined other internal rules of different countries and international treaties which in their texts articulated, make mention of this assumption. Secondly, I have continued the study determine the concept and elements that are part of this fundamental right within our legal system, from the jurisprudence of the Constitutional Court, Supreme, among other courts. Then I analysed the draft European directive is pending that wants to homogenize this procedural constitutional guarantee among Member States of the European Union. In the third and fourth part of the work I analyse what is the dimension and linking this procedural guarantee parallel trials and journalistic phenomenon (independent sphere) and the Spanish courts when they condemn an innocent (procedural sphere). Real cases, current press clippings, and proposals to mitigate a possible violation of law accompany all this study. Therefore, all of this are features that offer a degree to work closely linked to the political and social scenario in which our country is undergoing.
