Abstract:Everyone has a set of fundamental rights that are inherent and very personal, which happen to be violated in many cases, this phenomenon being reflected by scourges such as trafficking in persons for sexual exploitation, which main victims are women, immigrants and children. And it is that through such evils it is made a violation of the human rights of the person who is the victim, and that its integrity is breached to the extent that coerces the person in order to obtain his/her consent, and all of this for that person to be sexually exploited, which is confronted with freedom, unable to freely choose a profession or trade. It should also be noted the dignity of the person, who is violated for being seen as an object instead of a person, not a rational being as it really is, which is demonstrated to the extent that these victims are moved from their origin positions to be exploited later. This description results to correspond to forced character prostitution, by which such conduct has been characterized as criminal, for being an infringement of human rights of people. Now, the question is whether that profit by means of a third of alien prostitution should be considered as legal or illegal, when in this has not existed exploitation or coercive measures, but it has been done on a voluntary basis by means of the person who commits it. And, in the case that this activity has a legal character, maybe it could be considered whether it can be considered a work. Thus, this present study pretends to give an answer to these questions, in the measure that the prostitution's exercise results to be one of the biggest taboos of Labour Law.
