Abstract:
The object of this work is to make a study on the capture and recording of the image and sound using video cameras, paying special attention to the workplace. Video surveillance is a recurring topic in today’s society, it has become an activity present in all kinds of spaces, whether in the public scope (roads, streets, parks, etc.) or the private scope (buildings, companies, households, etc.). Video surveillance systems main applications focus on ensuring the safety and protection of goods and people or on the vigilance and control of employees within a business environment. The use of this tool can lead to a long list of infringements on fundamental rights such as privacy, self-image, data protection, the inviolability of the home, ideological freedom and the right of assembly and demonstration, including others. Indeed, some authors have defined video surveillance as the restrictive measure able to affect a wider range of fundamental rights. The appearance of new technologies has also revolutionized the world of labor relations. Video surveillance exponentially increases the power of vigilance and control that employers show. Given the limited regulation existing in Spanish legislation on this area, the courts are in charge of defining and establishing criteria delimiters and the duties and obligations of employers for this measure, in order to safeguard fundamental rights of workers.
