Abstract:
Work named " Mutation of the Spanish electricity sector and the question of the tariff deficit" discusses, the one hand the different energy models that have existed in Spain since 1980 until today, and the other hand the causes and the consequences of the impact of the tariff deficit electrical . First of all highlights the different regulatory framework governing the electricity sector. Passing of a system fully involved by the Public Administration, a one system partially liberalized and opened market system, as a result of the transposition of the Directives of the European Union. Special mention to the functioning of the various electricity markets currently operating in Spain is carried out. Also mentions public subjects that ensure the proper functioning of the entire electricity sector, management, supervision and control. Indicating in each what are its main tasks to develop and the need for these subjects there. More incisively explains the causes that have led to the tariff deficit in the power sector, policy solutions that were applied in the beginning, 15 years ago, and which are now being applied to solve it. Together is also highlights the reasons for which the jurisprudence of the Supreme Court, National Court and Constitutional Court give their support to some sudden changes in the rules of this sector, which have caused discontent and legal uncertainty among private companies working in the electricity sector. Finally, the work mentions the possible consequences that may be in the future as a result of this, both, electricity consumers and companies related to this sector.
