Abstract:
What I pretend to do with this research is to analyze if there is an effective application of the religious education, being focused on minorities religions which Spain has subscribed cooperation agreements: Evangelical, Jewish and Islamic. The purpose is to conclude if minorities religions rights are being respected in public schools, in relation with articles 16 and 27.3 of the Spanish Constitution, being focused only in Catalonia, due to it’s a shared competence. The scheme of this analysis consists, first, in explaining what freedom religion right is in so far as fundamental right, explaining its characteristics. From this right are derived those cooperation agreements, and subsequently the article that guarantees religious education right was redacted. Then, I get focused on religious education right regulation, both in cooperation agreements and its regulation in Spain and Catalonia. Finally, it’s analyzed its implantation and the effective (or not) application of this right. To be able to make this research, I’ve read different bibliographic sources, legal articles and data provided by the administration and religious confessions.
