Abstract:
This article deals with the Queer thinking, how it was originated and how it has influenced to the people who follow this philosophy. Queer theory argues that gender identities and sexual orientations are social constructs and criticizes the present binomial existing genres. We will relate this thought with the new Catalan law against homophobia, transphobia, biphobia pioneer in the Spanish state and in Europe. The following research is also addressed to this law highlights as intersex and gender expression, and will investigate the possibility of defend the Queer theory from a legal field, making less vulnerable and creating new expectations for the Queer thinking.
