Abstract:
The aim of this final degree project is to collect, in a single document, an historical and juristic study on the right of reversion in the Spanish urban scope, taking a closer look in one of the most important areas of the Administrative Law, with more legislative ramifications, at once that are analyzed different assumptions when the reversion is appropriated and its exceptions in the scenarios of urban expropriation. This subject has been chosen due to the lack of studies on this matter, versed on the legislation in force, that collect wide and deep information on the reversion right in urban matters. In order to develop this study, first of all I studied the history of the reversion right in the Spanish law, from its background to the legislation in force. In second term, I have made the dissertation from the legal viewpoint in response to all the shadows on the right of reverse in urban matters: its factual cases, features, procedures, deadlines and effects. The right of reversion is a legal configuration right that arises from our Constitution, as well as the right of the expropriated person to cease the effectiveness of the expropriation when disappears the cause that motivated it. The reversion is one of the fundamental guarantees of the citizens. The Obligatory Expropriation Act justifies and legitimizes the singular deprivation of private property or of legitimate patrimonial rights or interests, by means the exercise of expropriation, in the public or social interest. The reversion is rational when the accomplishes its objectives and recognizes to the expropriated citizen the right to regain the expropriated goods.
