Abstract: El treball porta per títol “ Habitatge digne i pobresa energètica: un dilema a solucionar”, s’ha pretès desenvolupar tres eixos bàsics, el primer d’ells la no consideració del dret a l’habitatge com a dret fonamental en el marc normatiu espanyol, i les repercussions d’aquest fet; el segon la consideració contraria de la jurisprudència europea respecte el primer eix; i un tercer eix que seria la relació entre l’habitatge digne i la pobresa energètica. En cada eix es desenvolupen una sèrie de qüestions relacionades amb el mateix, com són: El dret a l’habitatge com a dret humà i com a dret fonamental; el dret a l’habitatge com a dret social; el dret a l’habitatge en el marc normatiu espanyol, distingint la regulació en les Comunitats Autònomes, el règim de tinença, habitatges desocupats i les polítiques d’habitatge; anàlisis jurisprudencial; la pobresa energètica en el marc normatiu europeu, espanyol i català. The title of this academic study is “Habitatge digne i pobresa energètica: un dilema a solucionar”, has been developed in tree main axis, the first of them is about the non-consideration to the right to housing as fundamental right in the Spanish regulation frame and the repercussion of this fact; the second one is the non-consideration of the European jurisprudence linked to the first axis; the third one is the existing relationship between the dignity housing and the energy poverty. In each axis is developed a bunch of questions: The housing right as human right and fundamental right; the housing right as social right; the housing right in the Spanish normative; discerning the regulation in the autonomous community; the system of possession, unoccupied homes and housing policy; jurisprudence analysis; the energy poverty in the normative frame in Europe, Spain and Catalonia. El trabajo lleva por título “ Habitatge digne i pobresa energètica: un dilema a solucionar”, en éste se ha pretendido desarrollar tres ejes básicos, el primero de ellos la no consideración del derecho a la vivienda como un derecho fundamental en el marco normativo español, y las repercusiones de éste hecho; el segundo es la consideración contraria de la jurisprudencia europea respecto el primer eje; y un tercer eje que sería la relación entre la vivienda digna y la pobreza energetica. En cada eje se desarrollan una serie de cuestiones relacionadas con el mismo, como son: el derecho a la vivienda como derecho humano y como derecho fundamental; el derecho a la vivienda como derecho social; el derecho a la vivienda en el marco normativo español, distinguiendo la regulación de las Comunidades Autónomas, el régimen de tenencia, viviendas deshabitadas y políticas de vivienda; análisis jurisprudencial; la pobreza energética en el marco normativo europeo, español y catalán.
