Abstract:
Analysis, definition and conceptualization of workplace harassment, obeying rules from the outer to the Spanish legal system, based on the definition provided by the International Labour Organization: “All action, fact or behaviour that it’s got off a reasonable behaviour, whereby a person is attacked, threatened, humiliated or injured by other one during the exercise of his/her professional activity or, if it’s produced as a direct consequence of the professional activity”; and at the same time, analyzing the offensive conducts in the context of a job environment. So much so, that it damages the individual and the fundamental rights like the personal dignity (art. 10 of the Spanish Constitution), the personal integrity (art. 15 of the SC), privacy (art. 18 of the SC) freedom of expression (art. 20 of the SC), equality and not discrimination (art. 14 of the SC). To conceptualize the workplace harassment it’s divided in objective elements and subjective elements that they help to describe the workplace harassment’s behaviour identifying the different kinds of this conducts. Also, for the improving of a clear concept of mobbing, it’s necessary the comparison with other related concepts like work stress, sexual harassment, burnout, discrimination, etc. We can make an analysis of the interpretative judgments by the Courts to discern the workplace harassment of other related concepts.
