International community's response to climate change: past, present and future

    Abstract:
    Based on the contributions made by the scientific community about the origin, consequences and mechanisms against global warming, this paper aims to analyze the response that the international community has been given to the problem of climate change until the present time and discuss features that should gather a legal instrument to be effective in this struggle. The first chapter describes in a chronological way the relevant highlights that have raised awareness of global warming and the consequent problem of climate change caused by human activities. The second chapter analyzes the political negotiation process from 1972 to the present that have configured the international legal system of climate change. The two most important exponents of this legal system are The United Nations Framework Convention on Climate Change (UNFCCC) and the Kyoto Protocol. Finally, the third chapter analyzes in a prospectively way how the international community should react after the last report of The Climate Change Expert Group (CCXG) of this year and also proposes some basic features that an international legal instrument should have to be effective against global warming and the consequent climate change associated.
