Sostenibilitat i canvi planetari. Sobre la necessitat de revisar els fonaments del Dret ambiental tal com el coneixem

    This paper analyses the plausibility of the idea of sustainability as a core concept when designing the political and legal response to the global environmental crisis, starting with the so-called Brundtland Report and its projection in contemporary environmental law, culminating in the definition of the United Nations Sustainable Development Goals. The thesis defended here is that sustainability is incompatible with the historicity of the planet and that the global environmental crisis responds to a process of planetary transformation in which historical time and geological time are coupled. This generates a modification of the Earth System as a whole that is incompatible with the objective of indefinitely fixing its configuration, an objective implicit in the concept of sustainable development. It is, therefore, necessary to abandon the aspiration to establish a stable cycle of reproduction of planetary dynamics and to generate narratives and concepts that allow us to confront the transformations underway. In this sense, it is proposed to explore the idea of resilience as an appropriate concept for constructing adequate social practices in the critical context in which we find ourselves.
