Abstract:
Article 149(1(29)) of the Spanish Constitution (CE) drafts public security as an exclusive competence in favour of the Central State. This delimitation of powers has not prevented the City Councils to deploy competences in the field. The reason for this deployment gives answer to the interpretation that is done from the Constitution itself and the norms that develop it in the Spanish State. Addressing and acknowledging the competence of the municipalities in the field of public security, the examination of such competence is key in order for the local Administrations to be able to transform the allocation of competences in a public policy in favour of the citizenry. The comprehension of the scope of this competence facilitates to the reader which are the municipal opportunities and limits in this field of power. In this chapter it will be analysed the concept of public security and its legal framework with due respect to its own impact in the local municipal policy.
