Abstract:
This article examines vicarious violence as one of the most severe and least visible expressions of gender-based violence, in which children are instrumentalised to inflict harm and maintain control over their mothers. Building on the international framework on human rights and the Council of Europe Convention on preventing and combating violence against women and domestic violence (Istanbul Convention), the study analyses the obligations that shape the standards for protecting women and children, and which guide state action. At the state level, it explores the evolution of Organic Law 1/2004, together with the development of public policies and coordination protocols. In Catalonia, it highlights the pioneering legal recognition of this phenomenon and the configuration of a comprehensive model based on inter-institutional cooperation and coordinated intervention involving the social, health, educational, police and judicial systems. Despite this progress, the study identifies four structural challenges: effective coordination between institutions; lack of uniform indicators; the gap between the law and its application; and the prevention of institutional violence. The article concludes that effective protection requires a stable, cohesive, multilevel system focussed on children's best interests.
