Resumen: The strategy of governments and public administrations to adapt to today’s society is based on the conviction of establishing the paradigm of open government in public management, being a necessary premise for this to be possible a good basis for access to public information, both active and passive, so that citizens can exercise an evaluation and control of the public management, allowing them, in turn, to become key players for collaboration in public action and management. Thus, a legal system is taking shape that revolves around transparency as the central axis of change, and despite the fact that the obligations deriving from it are mainly aimed at public sector bodies, the various legislators have broadened the range of obligated parties to include private entities as well, in order to avoid as much as possible any level of opacity in relation to the traceability of public funds. Thus, this study aims to elucidate, in the light of the applicable regulations and the criteria established by the specialized doctrine, what is the scope of the transparency obligations of private foundations providing public health services.
