The Spanish historical trend to promote protected housing for sale causes current difficulties to comply with the Constitutional mandate (article 47 of the Spanish Constitution) to ensure access to decent and adequate housing for the entire population. Only in the wake of the 2007 crisis, the legislator has the will to increase, by all means, the percentage of social housing in Spain, coinciding with the existing recommendations of the doctrine, and despite the poor reliability of the existing data. Nevertheless, in Spain, this trend to “build for sale” has led to a lack of development of a legal framework for social housing management, which is essential to maintain and foster the increase of a sufficient social housing stock. Thus, given this situation, we understand that Spain should adopt a functional, common and coherent social housing management model that allows to structure and improve the efficiency of a highly atomized and unstructured sector. Consequently, this doctoral thesis designs and proposes a model of provision and management of social housing for Spain, following European models that have proven to have adequate management capacity on large social rental housing stocks for decades. Thus, we undertake an in-depth study on the Dutch woningcorporaties and the English housing associations, of which we emphasise its unitary regulation and public control, the establishment of management structures and diversity in its portfolio of activities while trying to correct the mistakes made.
