Abstract:
This research focuses on the environmental impacts of the activities of the European TNCs, which contribute substantially to the current environmental crisis and threaten present and future generations. At present, the misalignment of the economic forces created by the process of globalization, the vacuum in corporate governance and the inability of states in the Global South to regulate the activities of TNCs mean that the regulations set by national authorities are unable to prevent severe environmental degradation. In turn, people affected by environmental impacts face several obstacles when attempting to hold corporations environmentally liable and to seek redress and justice for the damage suffered. This doctoral thesis aims to I) analyze how European TNCs have expanded by relocating their activities to third countries, II) study the socio-environmental impacts of the relocation of European TNCs to third countries, III) search for legal avenues to prevent and reduce the environmental impacts of European corporations in host states, IV) study the role of the EU, European institutions and member states in fostering mechanisms and tools to regulate the environmental impacts caused by corporations beyond the EU’s borders, V) analyze the legal measure adopted by EU institutions and member states to regulate the activities of European corporations in third countries, VI) inquire into the obligations of the EU, its institutions and member states to guarantee access to judicial remedies for people adversely affected by the environmental impacts of corporate activities in third countries and VII) identify the obstacles that people adversely affected in third countries face when seeking effective remedies before the courts in EU member states.
