Análisis del régimen jurídico del canis lupus signatus en la Península Ibérica

    Abstract:
    The canis lupus signatus in the Iberian Peninsula, the Iberian wolf, is a species that has always been subject to much social and legal conflict. It was based on a regulation that did not conform to European legality, which resulted in an important legal insecurity for the protection of the species that led it almost to extinction. It was not until 2021 that an attempt was made to partially solve this problem in Spain. This work carries out a transversal study from the perspective of the legal and biological science of the species where the legal adequacy and its management system are assessed before and after Order TED/980/2021. It is analysed from the international, European Union, national and regional perspectives. With this new order, the objectives and hypotheses of this legal research are partially fulfilled, since it represents a radical change in the paradigm of protection of the species. Until 2021 it was a species subject to hunting activities. Now it becomes a species under a special protection regime, with the legal consequences that this entails. However, this order is still insufficient in accordance with the Habitats Directive, which requires guaranteeing not only an adequate protection regime, but also a favourable conservation status of this species in the long term.
