Resumen:
The objective of this research is to analyze the scope and limits of popular consultation as a mechanism of participatory democracy to regulate extractive activities of the mining industry in Colombia. For this research, a qualitative, descriptive methodology is implemented, based on a review of the literature that allows relating the normative, jurisprudential, doctrinal analysis and related documents issued from different national and international entities, in order to identify the characteristics of socio-environmental conflicts in Latin America and Colombia, to later present a general perspective on mining activity in Colombia, taking into account its history, current events and challenges. Finally, the popular consultation will be addressed, its impact as mechanisms of citizen participation, the contribution of international management for its strengthening, national regulation, concluding with the scope of the norms, according to the decisions given by the Constitutional Court and the Council of State.
