Alternative law and legal pluralism: the case of Roma ethnic minority

    Abstract:
    The identification between law and state sovereignty justified the legal monopoly of the modern state, but with the emergence of new actors affirmed as creators of a legal alternative signs the crisis of state law and broaden the conceptual boundaries right. This TFG highlights the complex sense of legal pluralism and the alternative right from a dual perspective that questions monistic conception that it has reduced the diversity of society endemic to a single dominant view of the law. All this is complemented with a practical analysis of a series of judgments by TEDDHH, using as criteria for selecting the origin of the applicants, in their entirety the Roma ethnic minority and the type of law and violated safeguarded by the Strasbourg Court itself.
