Abstract:
This essay makes an analysis of the "International Convention on the Protection of the Rights of all Migrant Workers and Members of their Families" and said the responsible for ensuring that it is complied, like the Committee for the Protection of the Rights of All workers and their Families and the Special Rapporteur on the Human Rights of Migrants, and his annual reports over the past 14 years since it was founded. Initially this essay focusses on studying the phenomenon of migration and why so many people migrate from their home country. Later examines the history of this Convention and the difficulty that United Nations found when they finally reached the minimum number of ratifications for it to be effective; as well as the main objectives to be achieved for the Convention. Finally, it analyses the actual Spanish situation regarding the non-ratification of the Convention and the reasons why it would be a breakthrough for the Spanish migrant sector, which it ratified. In summary, the essay examines the minimum rights that the Convention grants to migrants, regardless of their regularized or irregular situation and seeks effective equalization of rights and duties of migrants and nationals of the host country. The Convention recognized what should be the rights of migrants in relation to their inherent dignity and rights of the human condition minimal.
