The Nuclear Safety Council: Independence and Transparency

    Abstract:
    The present project aims to study the independent agencies, both in the law of origin as in the Spanish law, of nuclear regulators and, in particular, of the Nuclear Safety Council (CSN) as a first experience of independent agency in Spain. This study first explains the general concept of independent agency in the law of origin, the American law, and which characteristics have that type of organisms with the study of the American nuclear regulator, the Nuclear Regulatory Commission. Then, as the central theme of this project, we analyze the introduction of independent agencies in Spain and which characteristics have that type of organisms in Spain. For this analysis, the Nuclear Safety (CSN) is taken as an example to explain the application of the independent agencies in Spain and to establish the appropriate comparisons with American law and its nuclear regulator. Finally, we also do an analysis of the innovations introduced by the reform of the law of CSN in 2007, which represents a deepening of their independence and the introduction of the principle of transparency in the functioning of the CSN with the recognition and regulation of the access right to the CSN’s information and the creation of a Technical Advisory Committee to improve the transparency of the CSN .
