Abstract:
In the present “Trabajo final de Grado”, I have examined the crime of murder departing from the interest that was provoking me immediately after such a big reform to which one wants to submit him, realizing a study where I have departed from the historical evolution up to coming to the Penal Code of 1995 and to this bill of reform. This historical study has travelled from 10 orders up to the “Novísima Recopilación”, happening for XXII tables, Lex Cornelia of Sicaris et Veneficis and the Partidas of Alfonso X “El Sabio”, laws that have had a great importance in the regulation of the crime of murder and this circumstances. Later I analyze the evolution of the crime of murder of the different penal codes, realizing the comparative one of the crime typified from the first Penal Spanish Code, that of 1822, up to the current one. In the analysis of the current Code, I refer to the circumstances that have been suppressed, and those who nowadays stay in relation to the previous codes, where also I analyze the suppositions of eventual deceit. How strong point of this work, I dedicate it to the Critique of the Project of the Organic Law of 20 of September of 2013 by which the Penal Code of 1995 is modified, analyzing what is kept, it of new introduction, and an important critique to the rules compete for them and taxable sorrow in the crimes of murder, giving at all time my critical opinion since the new circumstances that get in this modification, are going to be a sure source of problems, at the moment of this interpretation and the difficulties compete that this will carry. To conclude the study I dedicate a few words to the justification of it unnecessary that develops this reform, since the priority intention of this one is the introduction of the permanent revisable prison.
