LEGITAMATION ON SOCIETIES GROUP INTEREST, THROUGH SEARCHING SOLUTIONS TO THE INTRAGROUP CONFLICTING INTERESTS

Abstract:
This study is an attempt to deal with the group of companies from a global perspective to understand the specificity of this business reality that causes legal problems, with a particular attention to the implications of the contradiction between economic unity and legal pluralism, the configuration of a singular management and the interest of the group emergence. Before making an assessment of its characteristic features the difficulty of building a single definition of the concept of group, the inadequacy of the company law and the need to legitimize the interest of the group, this raises some possible solutions to balance the different interests coexisting in the group and to avoid their opposition. We uphold the balance between these interests for the proper functioning of the group without disregarding the particular lawful interests in need of protection.
