Abstract:
The objective of this work is to study the dation in payment, it is a legal figure in the Spanish legislation. During the last years that figure has become important for socials demands that claim his application, as a result of the economic and financial crisis in Spain. The aim is to analyze the characteristics that make the dation in payment and the effects that it can produce, but these effects are insignificant because there are too many difficulties and requirements to apply the dation in payment. The incidence of government to society has been insignificant. The government hasn’t given enough solutions, as it hasn’t proposed any legal reform or some legislative change. The Spanish society is who has claimed solutions and alternatives to the situation which affecting thousands of families. This claims has realized though association like PAH, the most famous and known group of caring people. Outside the Spanish territory, it is studying what measures are applied in other countries, such as Germany, France, UK, USA and Brazil, among others, where most of these alternatives that offer this countries, offer to the debtor a second opportunity.
