Abstract:
The Final Project Grade presented is an analysis of the socio-environmental problems of Argentina through a specific case: the Mendoza case. In this paper, there is a description of the serious environmental situation that for years suffered, and continues to suffer nowadays, the Matanza Riachuelo River, located along the province of Buenos Aires, and the serious consequences that this contamination produces to the residents that are living near the river, especially those who lives in the Villas de emergencia, settlements without an urban structure, public services and basic living conditions. The situation improved due to a complaint by a group of residents of the Matanza- Riachuelo river basin, which was organized in a class action led by Beatriz Mendoza, and that originated a complex legal process that involved several agents. The case ended with a transcendental judgment for the country, as the Superior Court of Justice of the argentine Nation ordered the governments involved and the other defendants to realize a set of urgent actions identified in the Comprehensive Plan for Environmental Sanitation (PISA) to remedy the injurious situation where the river was. Through this judgement, the judiciary made a function of government that the executive had not been able to accomplish over the years.
