Abstract: This study is done in order to know if rural communities facing environmental conflicts in Latin America, require equal or greater legal protection for indigenous peoples, or if instead, are protected by legal mechanisms protection provided by both regional and international legal system. The opportunity of this study is justified for several reasons. First, in Latin America has the richest biodiversity on the planet, but in recent decades has been reduced as a result of the current production model based on the unsustainable use of natural resources causing an environmental crisis affecting whole continent. Second, should not be ignored that it is a current issue, because there are traditional communities in Latin America, as are indigenous people and rural communities, strongly vulnerable to the environmental degradation of their lands because of its vital relationship with the natural environment, which makes them particularly dependent on the proper working of local and regional ecosystems. The interest in this topic is even greater, if one considers, that almost all the cases given to the Inter-American Human Rights relating to human rights violations by environmental degradation are traditionally related to the rights of indigenous peoples.
