THE REGULATION OF ARTIFICIAL INTELLIGENCE IN THE EUROPEAN UNION AND ITS IMPACT ON THE INSURANCE CONTRACT

Abstract:
Artificial intelligence (AI) systems play an increasingly prominent role in the development of economic activity. However, its application raises risks in companies and fears in consumers. For this reason, the EU authorities promote a reliable and common legal framework to gain trust among European citizens. In the first part, the article analyzes its developing process and pays special attention to the recent Proposal of Community Regulation -of April 21, 2021-, classified as Artificial Intelligence Law. In the second part, the legal implications that these systems have on the insurance business are addressed, showing what their risks are, especially for consumers, and postulating the establishment of control and protection measures useful to achieve the necessary transparency in the insurance policies.
