Abstract:
The present study examines whether the differences in the granting of human rights by the various member states of a federal country constitute a violation of the prohibition of discrimination under international law. The Swiss federation with its member states (cantons) as well as the prohibition of discrimination of the United Nations Convention on the Rights of the Child (CRC) are investigated. It is examined whether the prohibition of discrimination of the CRC is violated against these children, because the children in different cantons enjoy differently extensive rights. This contrasts with the requirement from the CRC that children's rights be granted without discrimination throughout the territory of the signatory state. The criteria of discrimination are applied in order to investigate whether the different treatment of children by different cantons qualifies as discrimination. It turns out that this is basically not the case. The main reason is that the cantonal legal systems consist of a whole set of legal rules applicable within and delimitated by the jurisdiction of each canton, which is democratically legitimized by the own population of every canton. These cantonal rules apply equally to all inhabitants of the canton and must be granted without discrimination within the canton.
