The omission of legal inheritors in the Civil Law of Catalonia

    Abstract:
    The following piece of research aims to analyse “the omission of legal inheritors in the Civil Law of Catalonia”, regulated by the article 451-16 of Catalonia’s Civil Code. The origin of this legal figure comes from the roman law with the “Novel·la 115 de Justinianeu”, followed by the “Memoria de Duran I Bas” up until the code of successiones. In this piece, the concept is analysed, as well as its foundation, contents and effects. Furthermore, there is a comparison between the evolutions of the figures in Catalan law; with the aim to understand the reasons and consequences of today’s civil law.
