Abstract:
This TFG aims to analyze the ability of minors to perfect contracts, both in the general Spanish law and the civil law of Catalonia. The aim pursued in the development of the work is based on extracting a set of specific claims that provide solutions to some of the uncertainties hanging over the subject matter of study in the section dedicated to the conclusions. This research is based on an analysis of the applicable law, recognized doctrine and jurisprudence remarkable. The structure of the paper is set to Chapters, Sections and Sub sections and its composition is as follows. The first chapter, which corresponds to the introduction, sets the object of study and the reasons for it. In the second chapter, a systematic analysis of the articles related to the concept of capacity and the capacity of the parties to contract is performed. Items of legal texts analyzed correspond respectively to Spanish Civil Code of 1889 and the compilation of civil law of Catalonia, for reasons which are justified on the job. The third chapter is based on an analysis of judgments of judges and tribunals, classified according to the type of legal transaction concerned. In the fourth chapter some conclusions are established through the information gathered and analyzed throughout the research. Finally, in chapter five sources used to prepare the work, literature, law and judgments used are determined.
