Abstract:
The main objective of this Final project is to analyze the Gender Violence impact, especially, when it is produced within the problems we may live nowadays while delimitating cases in which there exists a relation of affectability. There are situations in which, occasionally there can exist even a bigger victim’s helplessness or vulnerability because of the difficulty to delimit a relation of affectability conception. Could there be a relation between two people who just see each other once a month sporadically, or between couples who keep meeting for six months? In forward to obtaining answers to these questions I am going to analyze different Spanish Tribunals’ interpretations analyzing them at geographical and temporal scale, as the requirements in forward to appreciating a relation of affectability are not regular, predominating disparate opinions. We can observe that Tarragona’s sentences require a lot of formalities in order to appreciate relation affectability, such as: continuity, stability, shared life project. It is possible to facilitate these requirement’s proof by some clues such as economic projects or house renting together. They are characterized by a restrictive interpretation as we must prove a lot of formalities as a relation of affectability must be almost equivalent to a marriage affectability. However, there are other sentences from other state Tribunals for which it is enough with formalities such as a duration of relationship, seriousness, commitment and overcoming the simple friendship. Depending on the Tribunal which we come in for, we can obtain a sentence more favorable or less, that is a thing that sometimes can lead us to a legal uncertainty.
