Abstract:
This work consists of an analysis of the recent reform of the Local Government Law 27/2013 caused by Rationalization of Local Public Administration (LRSAL). The approach is intended to give him is a theoretical and practical analysis of the most significant issues of the Local Administration that have been modified, its consequences and its relevance to the law and from the territorial point of view of Catalonia. Initially, it is intended to carry out an analysis of each of the modifications produced by LRSAL, exposing what the legislator established before and after the reform, its consequences and its actual application in municipal practice. Developing your application in municipal practice is carried out based on reports of Municipal Intervention department of Reus City, that reflect how they are applied in the municipal reality, some issues that LRSAL reformed. Here it comes into play additional and transitional provisions, including the law, that helps to integrate new concepts, but its content imply for their implementation, in some cases actual recourse to interpretations of advisory bodies, which will also be analyzed. The main problem of this reform is a Regional-State conflict in competence matters. Since the autonomous communities, the vast majority have autonomy statutes by which recognize local powers have been assumed and developed by sectorial laws, which often destroys this new local reform. This conflict is discussed in the work from an objective point of view, do not give way to any solution because it is the work of the Constitutional Court to nowadays resolve the matter, because they agreed to process the conflict in April 2014 and is still pending.
