Abstract:
The main purpose of the present work has been to analyze the legal regime of the different police forces operating in the state, they can be classified into three levels: a state level, a regional level and a local level. Moreover we have focused in this analysis to the legal regime of the local police in Catalonia that have been instrumental to municipalities to complete the local autonomy that constitutionally guaranteed in Article 140 of the CE. For this study we have relied on the existing distribution of powers in matters of public security, considering that we are in a state where the legislative and executive power is decentralized having a transfer of powers from a central government to other entities with legal personality and that precisely this phenomenon is reflected in public security as stated in Article 149.1.29 of the CE by which confers exclusive jurisdiction on the State's public safety without prejudice to the Autonomous Communities they can develop their own territorial police in the framework of that has their respective statutes of autonomy and provided appropriate to the organic legislation. Regarding the structure of the study, the first chapter talk about the legal regime of the local police at the state level, making reference to the existing legislation before the adoption of the CE, after the CE, the approval of the LOFCS state and local government regulations. Moreover, in the second chapter the legal regime of the local police level is analyzed at regional level, addressing the EAC, the own laws about security of Catalonia and local police as well as analysis of the municipal Charter of Barcelona. Finally, the third chapter perform different reflections and conclusions.
