Abstract:
This thesis receives as a name: “The voyage charter. Especial consideration to the new Ley de Navegación Marítima”. This thesis aims to study the Voyage charter contract, making particular emphasis both the new Spanish regulation and the international regulatory consideration thereof. Inside the chapters of this monograph we intend to cover each of the ends that make up the contract, such as the concept and characteristics, the regulations, the different related contract figures as time charter agreement or contract transport of goods under bill of lading, both personal and real and formal elements, the shipowner and charterer obligations, consideration of the lay days and demurrages, the termination of the contract and the responsibility of the ship owner for damage to goods carried . The main objective of this thesis was to analyze in depth the aforementioned contract. With this research we have tried to differentiate between the newly repealed regulation and the current one, and thereby clarify as much as possible the new legislation and realize the aims pursued by it. We start from a uncertain position somewhat due to the scarce jurisprudence considering the short duration of the new regulations. This monograph also includes many examples of actual contract terms, arising from the Law of forms, arranged as references to footnotes, to provide greater clarity and practical content to the explanations at work.
