Act 14/2013: Analysis of the Social Security and taxation novelties

    Abstract:
    2013 has been a productive year on legislative novelties for the taxation system and for the Social Security as well. The novelties have been introduced in order to improve Spain’s current economic recession. Some of the tributary novelties that should be highlighted are, for instance, the introduction of the Limited Liability Entrepreneur. This position should be differentiated from the Entrepreneur itself, since the first one cannot have its home seized, as far as it complies with the basic law requirements. Another novelty included by the Act 14/2013 is the position of the bankruptcy mediator, who has to mediate any disputes between the parts in conflict. These parts can still appeal to the process called Extrajudicial Settlement on Payments, which aims to avoid a legal process. Furthermore, new legislation on Social Security has been passed by means of the Additional Provision 35 bis of the Royal Legislative Decree 1/1994, 20th of June. This Provision enacts the consolidated restated text of the Social Security General Law. The Additional Provision 35 bis includes allowances for people both under and over 30 years of age, who wish to create a trading company for the first time. Finally, it needs to be noted that the IRPF, IS and IVA have been modified by the Act 14/2013.
