The conflict arising from corporate control by new technologies

    Abstract:
    The present work is entitled “The conflict that arises from the managerial control across the new technologies”, and is based on the problems that arises when the businessman uses the new technologies as a way of managerial control and, as these conflicts are regulated in the legislation and collective agreements. To be able to come to a few conclusions as regards this topic one has developed, on the one hand, the revolutions technologies that have existed along the history, an analysis of the revolution technology in which we are and, the society who has derived from this revolution, called information society. Also it’s analyzed as the new technologies have affected to the labor relations, in the ambience of the control that the businessman exercises on the labor activity and the conflict that arises between businessman and workpeople. Also there is realized a jurisprudential analysis of the hardware of managerial control that turn out to be more invasive to the intimacy of the worker and, the method that the courts use to be able to solve if the control methods are licit or not. On the other hand, a study is realized of how there is regulated the use of the TIC and its managerial control across the unilateral agreements of the company and the collective agreements. In this work it’s possible to observe how the new technologies have driven to a new type of highly technological society, where also the labor relations have evolved. But the legislation hasn’t continued the rhythm of this new society, leaving normative lagoons at the time of solving this type of conflicts. Also since it has been had that regular this subject-matter across unilateral agreements and collective agreements, it’s possible to observe that few collective agreements regulate the use and managerial control of the TIC.
