Abstract: El present treball es titula “El conflicte que sorgeix del control empresarial a través de les noves tecnologies”, i es basa en la problemàtica que sorgeix quan l’empresari utilitza les noves tecnologies com mitja de control empresarial i, com aquests conflictes es regulen en la legislació i convenis col·lectius. Per poder arribar a unes conclusions en relació al tema desenvolupat, per un costat, les revolucions tecnològiques que han hagut al llarg de l’historia, una anàlisi de la revolució tecnologia en què ens trobem i, la societat que ha derivat d’aquesta revolució, anomenada Societat de la informació. També s’analitza com les noves tecnologies han afectat les relacions laborals, en l’àmbit del control empresarial que exerceix l’empresari sobre l’activitat laboral i la conflictivitat que sorgeix entre empresari i treballador. També es realitza una anàlisi jurisprudencial de les eines de control empresarial que resulten més invasives a la intimitat del treballador i, el mètode que utilitzen els tribunals per resoldre si els mètodes de control són lícits o no. Por una altra banda, es realitza un estudi de com es regula la utilització de les TIC i el seu control empresarial a través dels pactes unilaterals de l’empresa i els convenis col·lectius. En aquest treball es pot observar com les noves tecnologies han conduit a un nou tipus de societat altament tecnològica, on també han evolucionat les relacions laborals. Però la legislació no ha seguit el ritme d’aquesta nova societat, deixant buits normatius a l’hora de resoldre aquest tipus de conflictes. També com s’ha hagut de regular aquesta temàtica a través de pactes unilaterals i convenis col·lectius, es pot observar que pocs convenis col·lectius regulen la utilització i control empresarial de les TIC. The present work is entitled “The conflict that arises from the managerial control across the new technologies”, and is based on the problems that arises when the businessman uses the new technologies as a way of managerial control and, as these conflicts are regulated in the legislation and collective agreements. To be able to come to a few conclusions as regards this topic one has developed, on the one hand, the revolutions technologies that have existed along the history, an analysis of the revolution technology in which we are and, the society who has derived from this revolution, called information society. Also it’s analyzed as the new technologies have affected to the labor relations, in the ambience of the control that the businessman exercises on the labor activity and the conflict that arises between businessman and workpeople. Also there is realized a jurisprudential analysis of the hardware of managerial control that turn out to be more invasive to the intimacy of the worker and, the method that the courts use to be able to solve if the control methods are licit or not. On the other hand, a study is realized of how there is regulated the use of the TIC and its managerial control across the unilateral agreements of the company and the collective agreements. In this work it’s possible to observe how the new technologies have driven to a new type of highly technological society, where also the labor relations have evolved. But the legislation hasn’t continued the rhythm of this new society, leaving normative lagoons at the time of solving this type of conflicts. Also since it has been had that regular this subject-matter across unilateral agreements and collective agreements, it’s possible to observe that few collective agreements regulate the use and managerial control of the TIC. El presente trabajo se titula “ El conflicto que surge del control empresarial a través de las nuevas tecnologías”, y se basa en la problemática que surge cuando el empresario utiliza las nuevas tecnologías como medio de control empresarial y, como estos conflictos se regulan en la legislación y convenios colectivos. Para poder llegar a unas conclusiones en relación a este tema se ha desarrollado, por un lado, las revoluciones tecnologías que ha habido a lo largo de la historia, un análisis de la revolución tecnología en la que nos encontramos y, la sociedad que ha derivado de esta revolución, llamada sociedad de la información. También se analiza como las nuevas tecnologías han afectado a las relaciones laborales, en el ámbito del control que ejerce el empresario sobre la actividad laboral y la conflictividad que surge entre empresario y trabajadores. También se realiza un análisis jurisprudencial de las herramientas de control empresarial que resultan más invasivas a la intimidad del trabajador y, el método que utilizan los tribunales para poder resolver si los métodos de control son lícitos o no. Por otro lado, se realiza un estudio de cómo se regula el uso de las TIC y su control empresarial a través de los pactos unilaterales de la empresa y los Convenios Colectivos. En este trabajo se puede observar como las nuevas tecnologías han conducido a un nuevo tipo de sociedad altamente tecnológica, donde también han evolucionado las relaciones laborales. Pero la legislación no ha seguido el ritmo de esta nueva sociedad, dejando lagunas normativas a la hora de resolver este tipo de conflictos. También como se ha tenido que regular esta temática a través de pactos unilaterales y convenios colectivos, se puede observar que pocos convenios colectivos regulan el uso y control empresarial de las TIC.
