The right to freedom and its restriction on foreigners

Abstract:
Due to the current time in which population flows, terrorism threats and economic crisis are the order of the day, and in which immigrants represent a large percentage of the total population, this work focuses on the effects on the right to freedom and personal security of foreigners. The main aim is, firstly, to carry out a study of the situations where the Spanish Constitution allows limiting the right to freedom of foreigners and, secondly, to analyse if the legislation in force secures and protects in an appropriate way this right when police forces, courts and government administration act. In order to achieve this purpose, it is going to be examined the assumptions where the Foreigners Act permits the detention of foreigners, as well as the situations not covered by this Act and that involve a restriction to the right to freedom through the application of this rules.
