Abstract:
This is a final grade work that as the title suggests, "The Law 21/2013, on December 9, environmental assessment: general approach to main modifications in the field of project EIA" it has the aim to elaborate a detailed analysis of this new legislation with very critical spirit, but without forgetting that we want that provide knowledge not only interpretations and ideas. Our study deals with the environmental assessment of projects solely because of their complexity and density. However, one of the legislator's objectives is to create a common and unifying terminology, so it was necessary to properly analyse this new legal body that unifies all the legal environmental assessment, insert superficially in the evaluation of plans and programs. It is clear that public authorities play an important role, and clearly undeniable that the mechanism of the environmental assessment is a useful tool, so that the administration use its resources to protect biodiversity. But it is necessary that the legislature has previously acted accordingly and equip the ideal characteristics of this medium. Made object studied in this work, which we analyse with the utmost rigour attending its complexity and the disparate opinion it has always characterized this area of law. Finally, in addition to the innovations that have a direct impact on this prevention tool, deals with problems that could eventually bring about an as comprehensive regulation, the main motivations that fueled the modification and the conservation banks of nature.
