Abstract:
This paper has tried to address an aspect of the reforms introduced during 2015 in the LECrim. Last year 2015 LECrim suffered several reforms, but we have tried to focus has been how new technologies will be able to enter the field of police investigation related to the judicial investigation of crimes in the investigation phase of criminal proceedings. Specifically, by LO 13/2015, of 5 October, the were introduced 588 d a), b) and c) LECrim arts. that have introduced two types of investigative measures require the use of technological means or in the words of the LEC "technical devices" to, first, identify the suspect by imaging or recording images in public spaces, for which it is not necessary judicial authorization, and secondly, to track and locate suspects (and possibly the corpus delicti, or effects of crime) for which it is necessary judicial authorization, except situations emergency. In three chapters we have tried to approach the fundamental rights of citizens who may be affected by the investigative measures under consideration, such as the right to privacy and the right to self-image; the guiding principles governing such investigatory measures (jurisdictional exclusivity, proportionality, specialty, suitability, exceptionality and necessity) and finally how to use these technical devices applied to image capture, tracking and locating of suspects and even body of the crime or the effects of crime.
