    Abstract:
    The present article goes about gender discrimination in employment. In a social context set under the basic structure of patriarchy, which advocates the sexual division of labor, women have historically been discriminated against. Nowadays women have achieved more presence in employment, but has not yet reached effective equality between sexes. Women suffer double discrimination, on one hand by being female and on the other hand by the difficulty of reconciling work and family life. The article’s aim is to provide the reader with an overview about the employment situation of working women and their possibilities of legal protection against discriminatory actions in the employment. Thus, it aims to identify the main discriminatory reasons that support these business decisions and analyze how the courts repair the caused damages to those who have suffered these type of actions. To achieve these objectives, the article begins reviewing the legal framework that regulate the principles of equality and non-discrimination based on gender in order to reach its effective implementation in reality by analyzing the most recent case-law in the workplace.
